Is it worth filing adultery charges against your wife? Or is it better to just file for annulment?

I’m about to file for annulment. My (ex) wife were married, even if our marriage is still valide.Est it advisable to file a case of adultery against her? Or is it better to file the cancellation and forget the rest?

Just annul the marriage and forget the rest. What’s done is done. Move on lucky escape my friend.

file the annulment and have it stipulated that she pays all court costs and other charges since she remarried. thats a bigamy charge

Courts don’t waste time on adultery charges these days. You probably can’t get an annulment under those circumstances. Just file for divorce, state that your wife has remarried while married to you, and the court may well forward to the district attorney’s office. Or you can notify the district attorney. Bigamy is a felony under state statues.

IF you consummated the marriage either before you said “I do” or after you can’t get a legal annulment, you will have to file for divorce. Also in the U.S. adultery is not grounds for divorce. If she got “married” in the U.S. for a 2nd time with out a decree of divorce from her first marriage then her 2nd marriage isn’t valid anyway and she is NOT your ex wife until the both of you receive a final decree of divorce.
